We here at Bracker & Marcus LLC wish you all a happy and healthy new year!

2019 was a big year for our firm. In addition to finalizing an $84.5 million False Claims Act settlement with a hospital chain alleged to have violated the Anti-Kickback Statute and Stark Law, we had three additional cases intervened and settled, including against a defense contractor and a compound pharmacy. We also filed over a dozen new False Claims Act cases as lead counsel and confidentially settled a number of whistleblower retaliation claims.

Julie continued her good work educating young attorneys in the ways of the False Claims Act, as a member of the Taxpayers Against Fraud Education Committee and National Employment Lawyers Association Success Program. She also had numerous speaking engagements, including presenting to the Georgia Chapter of Certified Fraud Examiners. All while experiencing the parenting paradigm shift of raising a high school freshman and a fifth grader.

Jason (who, after thirteen years of practice, can scarcely consider himself a “young lawyer”) founded the Young Lawyers Division of Taxpayers Against Fraud. He also successfully defended one of our whistleblower clients who was falsely accused of misusing company documents. He spoke about mediation at the False Claims Act Summit, had an article published by the Federal Bar Association, and was named an Attorney to Watch by Atlanta Attorney Magazine. And both Julie and Jason were again recognized by Super Lawyers Magazine.

And yet we expect 2020—which also happens to be our five-year anniversary—to be our best year ever! After taking a couple of years to find our footing as a new law firm, we have since been one of the most prolific False Claims Act law firms in the country, in terms of filing, interventions, and settlements. We represent whistleblowers in at least three qui tam cases that we expect to be intervened in 2020, including being part of a monumental settlement that we hope to be able to announce in the next few months. We are also actively litigating four declined False Claims Act cases, as well as arguing an appeal in front of the Sixth Circuit.

Fortunately, we have formed co-counsel relationships with some of the best qui tam trial firms in the country. Moreover, we anticipate announcing the addition of an experienced False Claims Act lawyer as of counsel to our firm!

So keep an eye out for these and other exciting developments as we enter a new decade and a new era in our firm’s history!
